Terms of Service

 

THIS FOLLOWING USER AGREEMENT DESCRIBES THE TERMS AND CONDITIONS ON WHICH BUCKET PASS, LLC. OFFERS ITS BUNDLED TICKETING SERVICE.

 

General. 

 

Bucket Pass, LLC. acts as an intermediary between buyers and attractions (“ATTRACTIONS”) to facilitate the purchase and sale of attraction tickets. All sales are refundable within six months of purchase, pending no part of the ticket ("BUCKET") has been used. To determine the promoted discount for every ticket, BUCKET adds the individual ticket price as sold in the ticketing booth of the ATTRACTION and compares it to the price promoted on the SITE. The price promoted on the SITE does not include the service fee, which is charged to cover credit card fees and international transactions. The following are the rules (“TERMS”) that govern use of the BucketPass.com Web site (“SITE”) by the user of the SITE (“USER”) and the conditions under which a pass is sold in the SITE. By using or visiting the SITE, USER expressly agrees to be bound by these TERMS and to follow these TERMS and all applicable laws and regulations governing SITE. SITE reserves the right to change these TERMS at any time; new TERMS are effective immediately upon posting on SITE. If USER violates these TERMS, BucketPass.com may terminate USER’S access to SITE, ban USER from future use of SITE, cancel USER’S ticket order, and/or take appropriate legal action against USER.

 

Attraction Choice. 

 

BUCKET partners with ATTRACTIONS in different destinations to offer a ticket that will grant the USER full access to their facilities at a discounted rate below the average aggregate ticket choice. To determine the promoted discount for every ticket, BUCKET adds the individual price of the ticket for an adult, child, or senior as sold in the ticketing booth of the ATTRACTION and compares it to the price promoted on the SITE.

 

USER understands that he / she may be elligible for other discounts at the ticketing booth for being student, physically disabled, Ecuadorian, resident, diplomat, etc. Furthermore, by purchasing a Bucket Pass and agreeing to these terms, USER understands that from time to time, some attractions promoted by this SITE may grant free access and that Bucket will not refund money for USERS who visit attraction on this day.

 

The price promoted on the SITE and the promoted discount does not include the service fee, which is charged to cover credit card fees and international transactions. Even with the service fee, the SITE guarantees USER will save money on aggregate ticket choice. If user wants to avoid service fee, USER has the option to mail a check, cash, or money order to Bucket Pass specifying name, email address, and nationality. In this case, tickets will be delivered electronically to USER's email.

 

USER is able to download this ticket after purchase by clicking on the link shown in the SITE or by clicking on the links in the email confirmation. This ticket will allow the USER to access the five ATTRACTIONS promoted on the SITE upon destination arrival. SITE does not act as a primary sale box office, unless otherwise stated. By agreeing to these TERMS, USER agrees that the purchase price for the BUCKET on USER’S order, which does not reflect the original purchase price of the ticket. 

 

Ticket Use.

 

USER will be provided one ticket for all four ATTRACTIONS. Once at the ticket box / entrance of the ATTRACTION, USER will need to show ATTRACTION their digital ticket from a mobile phone or tablet, or a physical ticket. Each ticket includes personal identification of name and country of origin; thus, USER will be asked to provide identification that should match that of the ticket. After verification of identity, the ticket will be scanned with a mobile or digital device or by recording the confirmation number in a computer or physically writing down the ticket number if technology is not available momentarily. If the ticket is valid through verification, the USER may enter the ATTRACTION. Only one entrance is permitted at each ATTRACTION from each purchased BUCKET.

 

TICKET is personal. If a USER purchased TICKETS for other visitors, the USER should receive different TICKETS  for each person. The information on these tickets should also match that of the visitors' IDs. A TICKET may not be validated more than one time at each ATTRACTION. If a user validates its ticket more than once at any attraction, BUCKET is obligated to invalidate this ticket permanently and no refunds will be given. If USER thinks that its ticket was validated more than once by an attraction, USER should report it immediately to support@bucketpass.com to prevent invalidation of ticket.

 

All attraction visits must be made within six months of the USER purchasing their BUCKET ticket. Only the USER whose name is listed on the ticket is permitted to use the ticket. The ticket will not be validated with any other name. BUCKET tickets are not transferable. Each ticket has a unique confirmation number; therefore, tickets may not be duplicated or attempted use by multiple persons, risking ticket to become invalid.

 

Refunds.

 

BUCKETS are fully refundable within six months of purchase from BucketPass.com for the price promoted on SITE, pending none of the tickets have been used by USER. Service will not be refunded in any case. Partial refunds are not allowed on any SITE purchase. Refunds may take up to 15 business days to process.

 

USER is obligated to check the ATTRACTION’s hours of operation before visiting. If an ATTRACTION is not allowing visitors in (due to ATTRACTION private activities or full capacity reached) or if ATTRACTION is closed at the time of visit, SITE will not provide refunds to purchase. USER will be provided one ticket for all five attractions they elect to visit. If ticket is lost, stolen, damaged, or destroyed upon arrival, the SITE and not the ATTRACTION will re-issue the ticket, exchange or refund the ticket. When USER purchases tickets, it is USER's responsibility to keep in a safe place if printed physically or ensure tickets will be accessible in location is secure digitally through a mobile device or otherwise.

 

Payment. 

 

All prices are in United States Dollars (USD) unless otherwise specifically stated. Payments and billing information asked on SITE is not stored or handled by BUCKET. Payments are handled by a payment gateway. Concerns or disputes related to payments (such as suspicion of fraud) may be handled by payment gateway. Any credit card from the list on the SITE from any country will be accepted.

 

Taxes. 

 

Prices stated on the SITE already include taxes paid at the location of the ATTRACTION. 

 

Credit Card Charges. 

 

USER’S credit card will be charged by SITE and not the ATTRACTION. USER might be charged an international fee or other fees by its credit card or bank. BUCKET is not responsible for any extra fees associated with purchase. If USER has any questions about charges on USER’S credit card statement, USER should contact SITE at support@bucketpass.com

 

Disputed Charges. 

 

USER is responsible for any and all legal fees incurred by USER, ATTRACTION, and/or SITE associated with USER’S disputed charges and chargebacks for purchases made on SITE. In no event will SITE or ATTRACTION be responsible for such legal fees.

 

Attraction Listings. 

 

SITE does not guarantee the accuracy of ATTRACTION information on SITE including but not limited to attraction name, attraction amenities, attraction hours, or attraction location. 

 

Ticket Holder Behavior Policy. 

 

The USER agrees to abide by all rules and policies of the venue where the ATTRACTION is located relating to conduct and behavior. Should the USER be ejected from the ATTRACTION for failure to abide by the venue’s rules and policies, USER shall be subject to all applicable fines and legal or other expenses associated with the ejection. USER shall not be entitled to a refund due to ejection from ATTRACTION for failure to abide by the venue’s rules and policies. Further, should the ejection result in the loss of the USER’s right to use any other ATTRACTION tickets, or the right to purchase other tickets from that attraction, USER shall be held liable for all reasonable costs, expenses, and losses associated with said loss, including but not limited to all direct, indirect, vicarious, consequential, exemplary, incidental, special or punitive damages, including lost profits.

 

Fraudulent Use. 

 

In order to protect USER from fraud, USER may be required to provide additional proof of identify on any order. Proof of identity may include but is not limited photocopies of public documents such as a state driver’s license or federal passport to verify name and country of origin. This information will be stored in the SITE and shared with the ATTRACTIONS recurrently for marketing and business analysis purposes.

 

Ticket Download. 

 

Electronic tickets or “e-tickets” will be available for immediate download. After placing an order, USER will be allowed to print the tickets, have them emailed, or digitally save a PDF file. Tickets should be stored off-line if being used digitally (by screenshot on mobile phone or saving PDF on device’s memory). It is important that USER provides accurate email address information during the order process, in the case of lost tickets. USER is responsible for contacting support@bucketpass.com if tickets are not received via email, be unable to download the tickets, or be unable to print the tickets. Neither SITE nor ATTRACTION will issue refunds for USER’S failure to provide a correct email address, failure to print the tickets, or failure to bring ticket to attraction. 

 

Ticket Recovery.

 

In the case of lost tickets, be it that an email address is no longer accessible or physical/digital tickets have been lost, USER may recover tickets by using the Find Tickets feature on the SITE. The USER will be required to enter specific credentials to gain access to the tickets, including date of purchase, USER email address, USER name, country or origin. BUCKET will handle these requests manually and hence, a 48-hour period may be required to process this. USER is responsible for contacting support@bucketpass.com if there’s any concerns or if no answer has been received. 

 

Links. 

 

This SITE provides third-party links to ATTRACTION websites. SITE cannot guarantee, represent, or warrant that the content contained in the sites is accurate, legal, and/or inoffensive. SITE does not endorse the content of any third-party site, nor does SITE warrant that these sites will not contain viruses or otherwise impact USER’S computer systems. If USER experiences a problem with a link from the SITE, please notify SITE at support@bucketpass.com and SITE will investigate USER’S claim and take any actions deemed appropriate at SITE’S sole discretion.

 

Violation of the Terms. 

 

SITE, in its sole discretion, and without prior notice, may cancel USER’S ticket order, or exercise any other remedy available to it. USER agrees that monetary damages may not provide a sufficient remedy to SITE for violations of these terms and conditions and USER consents to injunctive or other equitable relief for such violations. SITE may release USER information by operation of law, if the information is necessary to address an unlawful or harmful activity against SITE. SITE is not required to provide any refund to USER if USER is terminated as a user of SITE.

 

 

Intellectual Property Information. 

 

For purposes of these TERMS, CONTENT is defined as any information, communications, software, photos, video, graphics, music, sounds, and other material and services that can be viewed by users on the site. This includes, but is in no way limited to all original content. By accepting these TERMS, USER acknowledges and agrees that all CONTENT presented to USER on this site is protected by copyrights, trademarks, service marks, patents, or other proprietary rights and laws, and is the sole property of SITE and/or its affiliates. USER is only permitted to use CONTENT as expressly authorized by SITE or the specific CONTENT provider. Except for a single copy made for personal use only, USER may not copy, reproduce, modify, republish, upload, post, transmit, or distribute any documents or information from this site in any form or by any means without prior written permission from SITE or the specific CONTENT provider, and USER is solely responsible for obtaining permission before reusing any copyrighted material that is available on this site. Any unauthorized use of CONTENT may violate copyright, trademark, and other applicable laws and could result in criminal or civil penalties. Neither SITE nor its affiliates warrant or represent that USER’S use of materials displayed on, or obtained through, this site will not infringe the rights of third parties. All other trademarks or service marks are property of their respective owners. Nothing in these TERMS grants USER any right to use any trademark, service mark, logo, and/or the name of SITE or its affiliates.

 

SITE reserves the right to terminate the privileges of any user who uses SITE to unlawfully transmit or receive copyrighted material without a license or express consent, valid defense, or fair use exemption to do so. After proper notification by the copyright holder or its agent to us, and confirmation through court order or admission by the USER that they have used SITE as an instrument of unlawful infringement, SITE will terminate the infringing USER’S rights to use and/or access to SITE. SITE may, also, in its sole discretion, decide to terminate USER’s rights to use or access to the SITE prior to that time if SITE believes that the alleged infringement has occurred.

 

 

Disclaimers. 

 

SITE MAKES NO ASSURANCES THAT SITE WILL BE ERROR-FREE, UNINTERRUPTED, OR PROVIDE SPECIFIC RESULTS FROM USE OF SITE OR ANY SITE CONTENT, SEARCH, OR LINK THEREIN. THE SITE AND SITE CONTENT ARE DELIVERED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS. SITE MAKES NO ASSURANCES THAT FILES USER ACCESSES OR DOWNLOADS FROM THE SITE WILL BE FREE OF VIRUSES OR CONTAMINATION OR DESTRUCTIVE FEATURES. SITE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ALSO ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. SITE WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF SITE, INCLUDING WITHOUT LIMITATION, DIRECT, INDIRECT, VICARIOUS, INCIDENTAL, SPECIAL, PUNITIVE, LOSS OF BUSINESS, OR LOSS OF PROFITS, OR CONSEQUENTIAL DAMAGES, WHETHER BASED UPON BREACH OF CONTRACT, BREACH OF WARRANTY, TORT, NEGLIGENCE, PRODUCT LIABILITY OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.

 

SITE DISCLAIMS ANY AND ALL LIABILITY FOR THE ACTS, OMISSIONS, AND CONDUCT OF ANY THIRD PARTY USERS, SITE USERS, ADVERTISERS AND/OR SPONSORS ON SITE, IN CONNECTION WITH THE SITE SERVICE OR OTHERWISE RELATED TO USER USE OF SITE AND/OR SITE SERVICE. SITE IS NOT RESPONSIBLE FOR THE PRODUCTS, SERVICES, ACTIONS OF ANY THIRD PARTY IN CONNECTION WITH OR REFERENCED ON SITE.

 

 

Limitation on Liability. 

 

USER acknowledges that SITE is a venue allowing people to buy and sell tickets to third-party ATTRACTIONS. SITE has no influence over rules, regulations, policies, or operations of ATTRACTIONS. Except in jurisdictions where such provisions are restricted, in no event will SITE be liable to USER for any indirect, vicarious, consequential, exemplary, incidental, special or punitive damages, including lost profits, even if SITE have been advised of the possibility of such damages to incur at ATTRACTIONS. 

 

Governing Law. 

 

USER agrees that any controversy or claim arising out of or relating to the use of SITE will be governed by the laws of the State of Ohio without regard to its conflict of law provisions. USER agrees to personal jurisdiction by venue in the state and federal courts of the State of Ohio, Montgomery County.

 

 

Amendments. 

 

SITE reserves the right to amend this policy at any time.
